TERMS AND CONDITIONS OF THE MEGADISC ONLINE SHOP

  1. The Megadisc record shop, found at www.megadisc.pl, is based at Nowogrodzka 44 in Warsaw. The shop is open Monday to Friday from 11-19 and on Saturdays from 11-15. Tel/fax: 022 826 30 43. The owner of the shop, which has existed since 1991, is Jacek Leśniewski.
  2. Orders are processed and delivered within 3-28 days, unless one of the ordered items is unavailable.
  3. Every order placed by the Customer will be confirmed by an e-mail stating that it has been accepted. PLEASE NOTE! Receiving a confirmation does not mean that the title in question is currently in the shop.
  4. PLEASE NOTE! The vast majority of goods currently in the shop and available "now" (including by mail order) are marked as "AVAILABLE". Of course, it may occasionally happen that an item marked in this way has just been sold and is not available at that moment.
  5. We do not require immediate payment for items that are not currently in stock. We will notify you that the order is ready to be fulfilled by a separate e-mail or by phone.
  6. How to order records that are not in stock. Some records we have on site (marked "AVAILABLE"), and some we obtain from distributors (marked "SPECIAL ORDER"). These records can also be ordered – you only pay for them once we confirm that we can get them. Example: you order three records, two are in stock and one is not:
    1. You add all three to the basket. In the basket you will see them in two groups: "Available now" and "Special order – requires confirmation".
    2. You place the order as usual. At this stage you pay nothing.
    3. We check the missing record with the distributor and write to you by e-mail.
    4. If the record is available, we agree with you whether to send the two records we have straight away and the third one later, or to wait for the whole order. Obtaining a record usually takes 3 weeks or longer. We will agree the cost of any second parcel with you.
    5. If the record cannot be obtained, we remove it from the order, recalculate the shipping cost and you pay only for the records we send.
    6. Once everything is confirmed, we send you a PayPal payment link or bank transfer details. For cash on delivery, we simply send the parcel.
    Until you pay, you can cancel the whole order or selected records free of charge – just write to megadisc@megadisc.pl.
  7. In the event of any difficulties in fulfilling the order, the Customer will be notified electronically or by phone.
  8. An order will be fulfilled if it includes the recipient's telephone number, address and e-mail address. If there is any suspicion that false details have been given or that the ordering party has dishonest intentions, Megadisc reserves the right not to send the goods.
  9. The number of titles ordered is not limited.
  10. All prices are given in Polish zloty (PLN) and include VAT. The shop reserves the right to change the prices of goods on offer. Prices do not include shipping costs.
  11. For mail order sales, the shop offers the following forms of payment:
    - cash on delivery (the Customer pays for the parcel on receipt, to the postman or at the post office)
    - by bank transfer to the account:

    Free shipping (applies only to orders within Poland) is available for amounts:
    - when paying in advance by bank transfer: over PLN 300
    - when paying cash on delivery: over PLN 400
    Free shipping does not apply to PayPal payments.
  12. Ordered records can be purchased or collected in person at the Megadisc shop, at Nowogrodzka 44 in Warsaw - during the shop's opening hours.
  13. The Customer receives proof of purchase from us.
  14. VAT invoices are issued when the Customer indicates such a request on the order form. Making such a declaration authorises Megadisc to issue the invoice without the recipient's signature.
  15. An order may be cancelled by e-mail (megadisc@megadisc.pl) or by phone (022) 826 30 43. Only orders that are not yet being processed (i.e. the goods have not yet been ordered from the producer) can be cancelled.
  16. In accordance with the Act of 2 March 2002 "O ochronie praw konsumenta" (on the protection of consumer rights) - the Customer may withdraw from goods purchased in the shop without giving a reason within 10 days of the date of receipt of the parcel. This is possible only if the purchased product has not been used and its technical condition has not been impaired in any way whatsoever. The proof of payment or invoice received must be returned together with the goods. Megadisc guarantees a refund of the value of the goods, and the money will be transferred to a bank account or sent by postal order. Delivery costs are not refundable. The Customer also bears the cost of returning the goods.
  17. In the event of a complaint about defective goods, please send them (by registered post) to the record shop at the address: Megadisc, ul. Nowogrodzka 44, 00-695 Warszawa. However, the company does not accept any parcels sent cash on delivery. The cost of returning a defective item will be refunded immediately after we receive the parcel and accept the complaint. The returned item must be accompanied by the proof of purchase or invoice, together with a description of the reason for the return. The product will be replaced with a fully functional one whenever possible. If for any reason the goods cannot be replaced, the shop will refund the buyer the equivalent of the product's price or offer a choice of other goods available in the shop. An item is considered defective if it has an evident technical fault.
  18. Goods are securely wrapped in protective film (vinyl records are additionally reinforced with cardboard) and sent via Poczta Polska (Polish Post) as priority mail. Within Poland, a cash on delivery parcel costs PLN 26 (CDs) or PLN 28 (vinyl records), and for payment by bank transfer it is PLN 12 (CDs) or PLN 19 (vinyl records) - regardless of the number of titles ordered. For the InPost service, a parcel costs PLN 14. The shipping cost of other goods (books, posters, mugs) is shown in the basket before you place the order.
  19. We send goods abroad as Poczta Polska parcels - after receiving money sent to the shop's address or confirmation of payment to the company account. The shipping cost depends on the weight of the parcel and the country of destination.
  20. In accordance with Article 24(1) of the Personal Data Protection Act (ustawa o ochronie danych osobowych), the buyer's personal data will be entered into the Megadisc database solely for the purpose of fulfilling orders and will not be disclosed to other entities.
  21. Matters not covered by these Terms and Conditions are governed by the provisions of the Civil Code (Kodeks cywilny).
  22. Placing an order in the Megadisc online shop constitutes acceptance of these Terms and Conditions.
